Childcare Law

Here at Spire Solicitors LLP we have a team of solicitors with extensive experience in all aspects of the law relating to children. This is a very specialised area of law in which we have an excellent reputation.

There are two areas of law that relates to childcare:

Public Law – This involves actions taken by social services for the protection of the children. These can include court proceedings for the removal of children from their parents.

Private Law – This relates to disagreements between parents, grandparents or siblings about issues relating to:

  • Residence
  • Contact
  • Change of name
  • Specific issues relating to schooling or the upbringing of a child
  • Parental rights

We are contracted with the Legal Aid Agency to provide Legal Aid funding to those clients who meet eligibility criteria. Legal Aid is available for representation in Care Proceedings, Protective Injunctions (domestic violence or forced marriage protection orders); children under 18 in respect of the unlawful removal of children.

Furthermore, Legal Aid will be available for domestic abuse sufferers for divorce and other family proceedings and for Private Law proceedings to protect children from child abuse, provided there is evidence of the abuse.
